HONOURABLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.10288 of 2019 ORDER:

The prayer of the petitioner in this case reads as under:- "For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus declaring the action of respondent Nos.2 and 3 in entertaining deeds and documents in respect of the petitioner's open plot covered by Survey No.70 admeasuring 400 sq yards situated at Niknampura Village, Narsingi Gram Panchayat, Rajendranagar Mandal, Rangareddy District, bounded by North-Land of Syed Fayyaz, South-Land of Khaled, East-10' wide road, West-Neighbours property in spite of status quo orders in I.A.No.1055 of 2018 in O.S.No.1147 of 2018 dated 10.12.2018 passed by the Hon'ble VIII Additional District and Sessions Judge, Rangareddy District at L.B.

Nagar and also in spite of receipt of the petitioner's written representation dated 15.4.2019, as illegal, arbitrary, unjust and also against the provisions of Registration Act, 1908, and also against Articles-14, 19 and 300-A Constitution of India and to pass such other order or orders as this Honourable Court may deem fit and proper in the facts and circumstances of the case."

It is the case of the petitioner that in spite of a status quo order passed by the competent civil Court, the registration authorities are proceeding to entertain documents in relation to the land covered by the said status quo order.

Perusal of the material placed on record indicates that neither the status quo order nor a copy of the petitioner's representation, if any, that was received by the registration authorities has been placed on record.

Learned Assistant Government Pleader for Revenue, State of Telangana, would inform this Court that the Sub-Registrar, Narsingi, Rangareddy District, has not received any representation from the petitioner along with a copy of the civil Court order, if any.

SK, J WP.No.10288 of 2019 Dt:03.6.2019 Without approaching the proper authority with the material concerned, it is not open to the petitioner to directly approach this Court and seek its intervention.

The Writ Petition is accordingly dismissed on this short ground leaving it open to the petitioner to file a proper representation to the Sub-Registrar, Narsingi, Rangareddy District, along with full documentation in the event any civil Court order covers the field. Pending Miscellaneous Petitions, if any, shall also stand dismissed. No order as to costs.
