This Transfer Civil Miscellaneous Petition, under Section 24 of CPC, is filed to withdraw O.S.No.133 of 2016 pending on the file of XXIV Additional Chief Judge, City Civil Court, Hyderabad and transfer the same to XI Additional Chief Judge, City Civil Court, Hyderabad, to club and try along with O.S.No.956 of 2015 or vice versa. During hearing, N. Niyatha, learned counsel for the respondents, reported no objection to withdrawn O.S.No.133 of 2016 pending on the file of XXIV Additional Chief Judge, City Civil Court, Hyderabad and transfer the same to XI Additional Chief Judge, City Civil Court, Hyderabad.

In view of no objection reported by the learned counsel for the respondents, this Transfer Civil Miscellaneous Petition is allowed withdrawing O.S.No. 133 of 2016 pending on the file of XXIV Additional Chief Judge, City Civil Court, Hyderabad and transfer the same to XI Additional Chief Judge, City Civil Court, Hyderabad, to try and dispose of the matter along with O.S.No.956 of 2015 pending to its file leaving it open to the trial Court to exercise its discretion to try both the suits jointly or independently, in view of Division Bench judgment of this Court in Dh r on avaj j u la Vidy am ba v.
