ORDER
HON'BLE SRI JUSTICE ABTIINAND KUMAR SHAVILI CRIMINAL PETITION No.2637 OF 2019 ORDER:
The petitioner is the sole accused in Crime No.223 of 2019 registered on the file of Malkajgiri Police Station, under Sections 341, 354(D), 307 and 326 (B) IPC. By way of this petition, he seeks regular bail under Sections 437 and 439 Cr.P.C. The allegation against the petitioner is that he has been harassing the victim and forcing her to love him.
The learned counsel for the petitioner submitted that the petitioner is an Engineering student and studying final year and that the examinations are scheduled to be held from 13.5.2019 to 27.5.2019, He further submitted that the petitioner was falsely implicated in the above crime and that the de-facto complainant is a near relative of the petitioner. He further submitted that the petitioner was arrested on 14.4.2019 and ever since he has been in judicial custody. He further submitted that the petitioner is a law abiding citizen and he will cooperate with the investigating officer as and when required. Hence the case of the petitioner may be.considered for grant of anticipatory bail so as to enable him to appear for the ensuing final year examinations.
The learned Assistant Public Prosecutor appearing for the respondent - State would submit that the petitioner is forcing the de-facto complainant to love him and in fact he made an attempt to kill the de-facto complainant by pouring petrol and also threatened to kill her. He would further submit that the petitioner is not entitled to grant of bail as the allegations levelled against him are severe and grave in nature.
This Court, having considered the rival submissions, is of the view that the case of the petitioner can be considered for grant of bail as the petitioner has to appear for his engineering final year examinations, scheduled to be held from 13.5.2019 to 27.5.2019.
The petitioner is directed to be enlarged on bail upon his furnishing a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) to the satisfaction of the learned XVII Additional Metropolitan Magistrate, Malkajgiri, Cyberabad. The petitioner shall cooperate with the investigating officer as and when required.
