I.A.No.2 of 2024 Having satisfied with the reasons mentioned in the accompanying affidavit, this application is ordered. Delay of 571 days in filing the review petition is condoned.
I.A.Nos.3 of 2024 and 1 of 2026 I.A.No.3 of 2024 is filed by the petitioner/wife seeking to review the order dated 19.07.2022 in Tr.C.M.P.No.61 of 2022 passed by the learned Single Judge of this Court.
I.A.No.1 of 2026 is filed seeking permission of this Court to withdraw I.A.No.3 of 2024 (review application) with a direction to the learned II Additional District Judge-cum-II Additional Family Judge, Medchal - Malkajgiri District at Medchal to proceed
with F.C.O.P.No.49 of 2022.
Petitioner/wife has filed an application under Section 24 of the Code of Civil Procedure, 1908 vide Tr.C.M.P.No.61 of 2022 against the respondent No.1/husband and Sri Kandula Nageswara Rao to transfer F.C.O.P.No.841 of 2021 pending on the file of the learned XVI Additional District Judge-cumAdditional Family Judge, Malkajgiri, to be tried along with G.W.O.P.No.4 of 2022 on the file of the learned XV Additional District and Sessions Judge-cum-II Additional Family Judge, Kukatpally. The said application was allowed on 19.07.2022.
Learned counsel for the petitioner and respondent No.1 would submit that by the date of the said order, the aforesaid F.C.O.P.No.841 of 2021 filed by respondent No.1/husband was transferred to the file of the learned II Additional District Judge-cum-II Additional Family Judge, Medchal - Malkajgiri at Medchal, on administrative grounds.
The said F.C.O.P.No.841 of was renumbered as F.C.O.P.No.49 of 2022. Therefore, petitioner/wife has filed I.A.No.3 of 2024 to review the said order. The aforesaid F.C.O.P.No.841 of 2021 was renumbered as F.C.O.P.No.49 of 2020 and the same is presently pending on the file of the learned II Additional District Judge-cum-II Additional Family Judge, Medchal - Malkajgiri at Medchal.
In light of the same, I.A.No.1 of 2026 is allowed.
Consequently, I.A.No.3 of 2024 is dismissed as withdrawn. However, liberty is granted to the petitioner and respondent No.1 to file an appropriate application before the learned II Additional District Judge-cum-II Additional Family Judge, Medchal - Malkajgiri at Medchal, seeking divorce on mutual consent.
