HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY Writ Petition No. 15256 of 2012 ORDER :

This writ petition is filed seeking writ of mandamus declaring the action of the 1st respondent in according permission for erection of the bronze statue of Bharataratna Dr.B.R.Ambedkar in the junction of Nehru Road and Prakasam Road, Rajakapet, Tenali Town & Mandal, through Rc.No.1523/2010 H, dated 30.12.2011 and consequential action of the 7th respondent in awarding such contract in favour of the 8th respondent as illegal and arbitrary.

Heard Sri P.Devender, learned counsel for the petitioner and Smt. K.Mani Deepika, learned Standing Counsel for the 7th respondent.

This Court on 17.05.2012, while ordering notice before admission granted interim stay.

Smt. K.Mani Deepika, learned Standing Counsel for 7th respondent produced written instructions and para-wise remarks stating that the 7th respondent has awarded the contract to the 8th respondent only for improvement of Prakasam Road and Nehru Road Junction, Tenali, but not for erection of Bronze Statue of Bharat Ratna Dr.B.R.Ambedkar. Para 2 of the para-wise remarks read as follows: "2.It is to submit that, the 7th respondent has awarded the Contract to the 8th respondent only for improvement of Prakasam Road and Nehru Road Junction, Tenali, but not for erection of Bronze Statue of Bharat Ratna Dr.B.R.Ambedkar. As such the contention of the petitioner that, the action taken by the 7th Respondent in awarding such contract in favour of the 8th respondent as illegal, arbitrary and unconstitutional apart from being violative of g.O.Ms.No.

55 (Transport, Roads & Buildings (R-1) Department, dated 08.04.2003 is not tenable." Recording the same, this writ petition is disposed of. It is needless to observe that the respondents will follow the guidelines as envisaged under G.O.Ms.No.

Department, dated 08.04.2003 as and when such proposal arises. There shall be no order as to costs. As a sequel thereto, miscellaneous applications, if any pending in this Writ Petition, shall stand closed.
