ORAL ORDER:
Petitioner claims that his father purchased various extents of lands including land admeasuring Ac.0.93 cents in Survey No. 335/5 Chiruruwada North Kandriga village, Tirupati rural, Chittoor district through registered sale deed document No. 2017/66 dated 12.7.1966. After the death of his father his mother and other brother have executed a gift settlement deed dated 20.6.2007 in favour of petitioner in respect of land admeasuring Ac.0.93 cents in Survey No. 335/5 Chiruruwada North Kandriga village, Tirupati rural, Chittoor district, thus, petitioner acquired ownership and claims that his family is in possession of the subject land since 1966. When petitioner intended to sell the subject land, the 4th respondent-Sub Registrar informed that the subject land is Government land.
Petitioner claims that the subject land is private patta land and submitted a representation dated 18.12.2017 before the Tahsildar-3rd respondent to make correction of entries in revenue records. Alleging inaction on his application, this writ petition is filed. Heard learned counsel for petitioner and learned Government Pleader for Revenue and with their consent the writ petition is disposed of at the stage of admission.
Learned Government Pleader submitted that for mutation of name petitioner has to submit online application in prescribed form VI-A through State Government web portal and on filing such application along with supporting documents, the same shall be considered and disposed of in accordance with law.
Since petitioner has not submitted online application in prescribed form, without going into the merits of the matter, the writ petition is disposed of granting liberty to the petitioner to submit online application
for mutation of his name along with supporting documents and on filing such an application, the third respondent shall consider the entitlement of petitioner and dispose of the application in accordance with law by assigning reasons in support of the decision. No costs. Miscellaneous petitions stand disposed of.
