HON'BLE SRI JUSTICE U.DURGA PRASAD RAO Criminal Petition No.3085 of 2018 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C by the petitioners/A.1 and A.2 seeking to modify the order dated 22.02.2018 in Crl.M.P.No.15/2018 in Crl.A.No.141/2018 on the file of Addl. Metropolitan Sessions Judge, Cyberabad at L.B.Nagar and reduce the amount of Rs.10,00,000/- directed to be deposited by the said Court to a suitable amount.

2) Learned counsel for petitioners relied upon the order dated 24.08.2015 passed by this Court in Criminal Petition No.5163/2015, wherein the judgment of Apex Court in Dilip S.Dahanukar v. Kotak Mahindra Co. Ltd and another1, was referred. In that case, in respect of awarding compensation of Rs.15,00,000/-, the Apex Court directed to pay Rs.1,00,000/- as fine but observed that it all depends upon the facts of each case. Therefore, the imposition of the condition depends upon the facts of each case.

3) The petitioners/appellants are admittedly the Managing Director and Director of M/s. Uma Maheswara Paper Pvt. Ltd. Having regard to their financial status, this Court is not inclined to 1 (2007) 6 SCC 528

modify the amount of Rs.10,00,000/- directed to be deposited by the Additional Metropolitan Sessions Judge, Cyberabad at L.B.Nagar. However, considering the request of the learned counsel for petitioners, the time granted by the aforesaid Court to deposit Rs.10,00,000/- is extended from one(1) month to two(2) months from the date of this order.

4) Accordingly, this Criminal Petition is disposed of. As a sequel, miscellaneous petitions pending if any, shall stand closed.
