HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.10460 OF 2017 ORDER:

The case of the petitioner is that she is the owner of the land admeasuring Ac.0.46 cents in Sy.No.63/A of Etukuru Village, Guntur District by virtue of agreement of sale executed by the vendor of the petitioner. The petitioner presented the said document before the 3rd respondent for registration and the 3rd respondent entertained the same, but kept pending vide P.No.62/2015. Subsequently, on 14.09.2015 the 3rd respondent refused to register the said document on the ground that the subject land is included in the list of prohibited properties issued by the 4th respondent. Against the refusal order dated 14.09.2015, the petitioner preferred an appeal under Section 72 of the Registration Act, 1908 before the 2nd respondent. As no orders are passed, the present writ petition is filed. Learned counsel for the petitioner submits that though the subject property is erroneously included in the list of prohibited properties, the 3rd respondent refused to register the same and the appeal filed by the petitioner against the refusal order is not being disposed of so far.

Heard the learned Assistant Government Pleader for Revenue.

In view of the above facts and circumstances, the 2nd respondent is directed to dispose of the appeal filed by the petitioner in accordance with law, within a period of four (04)

weeks from the date of receipt of copy of this order and take action accordingly.

With the above direction, the writ petition is disposed of. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
