HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.3754 of 2016 ORDER:
1. Heard learned counsel for the petitioner and learned Government Pleader for respondents.
2. The petitioner's fair price shop authorization has been suspended by proceeding dt.25.01.2016 of the 2nd respondent on the ground that the shop was not being run by the petitioner but through her benami by name, Ch.Satish. The petitioner refuted the same and contends that considering the nature of allegations against her, it was unnecessary to suspend that authorization and such a view has been taken by this Court in the order dt.23.06.2015 in W.P.No.18227 of 2015.
3. Learned Government Pleader for Civil Supplies does not dispute this fact.
4. In the above decision, this Court held that the allegation that the shop is being run by a benami person can be verified even without suspending the authorization of the dealer. Therefore following the said decision, the impugned proceeding is set aside but liberty is given to the 2nd respondent to proceed against the petitioner with respect to allegation levelled against the petitioner and complete the enquiry within three months
from the date of receipt of a copy of this order after duly observing the principles of natural justice and binding decisions of this Court.
5. Accordingly, the Writ Petition is disposed of. No costs.
