2015-06-23R.Kantha Rao2 pages

HON'BLE SRI JUSTICE R.KANTHA RAO W.P.No.18310 of 2015 ORDER:

Heard learned counsel on either side.

This writ petition is filed seeking to declare the final order dated 25.06.2014 passed by the 4th respondent whereunder the petitioner was terminated from the post of Field Assistant, Narepalli Gram Panchayat, Kothacheruvu, as arbitrary and illegal.

The petitioner was appointed as Field Assistant in Narepalli Gram Panchayat, Anantapur District, under Mahatma Gandhi National Rural Employment Guarantee Scheme in 2006. While so, the 4th respondent vide order dated 25.06.2014 terminated the petitioner, alleging certain irregularities. It is brought to the notice of this Court by the learned counsel appearing for the petitioner that the petitioner has filed an appeal before the 3rd respondent-District Collector on 27.08.2014 and the same is not yet disposed of.

Since the appeal is pending with the 3rd

respondent-District Collector, I am not inclined to go into the merits of the case.

However, as the appeal is kept pending since long time, the 3rd respondent-District Collector is directed to dispose of the appeal within a period of eight weeks from the date of receipt of a copy of this order.

Accordingly, the Writ Petition is disposed of. No costs.

As a sequel, Miscellaneous Applications, if any, shall stand closed.
