HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE Writ Petition No. 22048 OF 2010 ORDER:
This writ petition was filed in September, 2010 challenging order dated 16.12.2008 issued by respondent No.3, awarding Civil Supplies Distribution Dealership (fair price shop) in favour of respondent No.5.
No interim order was passed by this Court at the time of admission of the writ petition.
In view thereof, learned counsel for the petitioner seeks liberty to the petitioner to make a representation to the concerned authority for cancellation of dealership. He submits that the petitioner on 12.10.2009 and 21.12.2009, had made representations to the concerned authority. But, those representations were also not considered.
In view thereof, and having considered the submission of learned counsel for the petitioner, I am satisfied that this writ petition can be conveniently disposed of by the following order: "1. The writ petition is disposed of as not pressed.
2. It is open to the petitioner to make a fresh representation to the concerned authority within a period of four weeks from today and with the said representation, he shall annex the earlier representations and a copy of this order. If any such representation is made by the
petitioner, the concerned authority shall consider the same on merits, in accordance with law, and after granting an opportunity of being heard to respondent No.5, expeditiously. It is made clear that this Court has not examined merits of the case."
Consequently, pending miscellaneous applications shall also stand closed. No costs.
