HON'BLE SRI JUSTICE S. RAVI KUMAR C.M.A.No.11 of 2010 JUDGMENT:

This appeal is preferred questioning order dated 04.08.2009 in I.A.No.782 of 2007 in O.S.No.291 of 2003 on the file of I Additional Junior Civil Judge, Bhimavaram.

2. O.S.No.291 of 2003 is filed by Gram Panchayat for recovery of possession and consequential injunction and that suit was dismissed for default on 17.08.2007, and to set aside that order, I.A.No.782 of 2007 was filed.

3. Respondents/defendants resisted the application and considering the contentions and rival contentions of both parties, trial Court dismissed the application on merits.

Challenging the same, present appeal is preferred.

When this appeal is taken up for hearing, appellant herein filed CMA MP No.27 of 2010 to expedite the hearing of appeal and that petition was ordered and directed the matter to be posted after summer vacation of 2010. In spite of that, appellant has not evinced any interest in getting the matter disposed of.

5. When this matter is listed today, neither the appellant is present nor any representation is made on behalf of appellant.

6. Considering these aspects, I am of the view that appellant has no interest in prosecuting the case. 7.

For these reasons, this Civil Miscellaneous Appeal is dismissed for non-prosecution.

No costs.

Miscellaneous Petitions, pending in this Appeal, if any, shall stand closed.
