THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO CONTEMPT CASE No.713 of 2018 ORDER:

This Contempt Case is filed alleging non-implementation of the order, dated 02.01.2018, passed in W.P.No.44965 of 2017. While issuing notice before admission, this Court granted interim suspension of the impugned order, dated 10.10.2017 on the ground of lack of jurisdiction.

Now, learned Government Pleader submits that pursuant to the orders of this Court, the petitioner joined duty on 06.01.2018 before the Collector, Bhadradri Kothagudem District. A separate order was passed by the District Collector, Bhadradri Kothagudem on 25.01.2018 reinstating the petitioner and he was posted as Naib Tahsildar of Palvancha. However, learned counsel for the petitioner submits that the petitioner was suspended thereafter. 3.

It is noticed that this Court passed order, dated 02.01.2018 on the ground of lack of jurisdiction and it was made clear that appropriate authority can pass another order. If the petitioner was kept under suspension by a competent authority that becomes a fresh cause of action and on that ground the present contempt case proceedings cannot be continued.

Accordingly, the Contempt Case is closed. Miscellaneous petitions, if any, pending in this case shall stand closed. There shall be no order as to costs.
