HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.7976 of 2003 ORDER:
When the matter is taken up for hearing, it is noticed that the petitioner has attained the age of superannuation. The petitioner is challenging the orders passed by the Industrial Tribunal in I.D.No.36 of 2001, dated 01.10.2001, wherein, no relief was granted to the petitioner. Before the Labour Court, petitioner was challenging the orders of removal. The petitioner is seeking a direction to set aside the orders of removal and to reinstate him into service.
This Court, in the aforesaid circumstances, is of the considered view that the relief sought by the petitioner cannot be granted at this point of time since the petitioner has already attained the age of superannuation. Therefore, this writ petition can be disposed of directing the 2nd respondent to pay service benefits for the services rendered by the petitioner prior to his removal, within four weeks from the date of receipt of a copy of this order, if not already paid. With these observations, the writ petition is disposed of. No order as to costs.
