HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.5532 of 2017 ORDER:

This writ petition is filed challenging the action of the respondents 2 to 5 in not conducting fair investigation in FIR No.116 of 2016 on the file of the 4th respondent and helping the 6th respondent in securing anticipatory bail.

2. Learned Assistant Government Pleader on the basis of the written instructions submits that there was no delay in investigating the case and the 6th respondent has obtained the anticipatory bail on 08.09.2016. Thereafter, the accused surrendered before the Judicial Magistrate of Class, Razole and was enlarged on bail on 12.09.2016. Even before that inquest was conducted on the dead body on 15.08.2016 and the viscera was sent to A.P. Forensic Science Laboratories, Vijayawada for chemical examination. He took some time to get report and after receipt of the report, the charge sheet was filed on 10.03.2017. Since final report was received on 10.03.2017, the delay was occurred in filing the charge sheet.

3. In view of the same, the writ petition is closed, as no further orders are necessary. But however, it is open to the petitioner to take appropriate proceedings in accordance with law before the competent criminal court, where the charge sheet is filed, if the petitioner is aggrieved of. There shall be no order as to costs. The miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
