Heard learned counsel for the petitioner and the learned Government Pleader for Municipal Administration & Urban Development.
The grievance of the petitioner in the present Writ Petition is the inaction on the part of the respondent Nos.1 and 2 herein, in granting permission for construction of building in the subject premises.
According to the petitioner, he made an application for grant of building permission in the month of January, 2016 but no action has been taken so far.
When the matter is taken up, on instructions, it is submitted by the learned Standing Counsel that, vide G.O.Ms.No.65 MA, dated 04.03.2016, the State Government approved online approval system through DPMS in all urban local bodies for issuance of building and layout permissions and instructed to implement online building approval system-DPMS by 30.06.2016. In fact, a letter bearing Lr.No.G1/1817/2017, dated 25.07.2017, addressed by the respondents-Municipality to the petitioner herein is placed on record and the same reads as under:
"With reference to your application filed, it is to inform that, as a part of urban reforms and Ease of Doing Business (EoDB), Government have proposed to undertake approval of building plans through online single window system which allows online applications, payments, tracking of status, approvals and issuance of certificates. Accordingly, Government vide G.O.Ms.No.65 MA, dated 04.03.2016, approved online approval system through DPMS (Development Management Permission System) in all urban local bodies for issuance of building and layout permissions and instructed to implement online building approval system-DPMS by 30.06.2016.
In view of the introduction of new policy, you are hereby requested to file application in online approval system to process as per rules".
In view of the above, the Writ Petition is closed with liberty to the petitioner herein to submit an application for building permission in accordance with G.O.Ms.No.65 MA, dated 04.03.2016 for consideration of the respondent Nos.1 and 2 herein in accordance with law.
As a sequel thereto, miscellaneous petitions, if any pending in this Writ Petition shall stand closed. There shall be no order as to costs.
