THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION NO.4797 OF 2009 ORDER:

This writ petition is filed seeking to issue writ of mandamus declaring the action of the 2nd respondent in issuing Circular vide Rc.No.C1/4284/08, dated 31-07-2008 directing the petitioner company to obtain licence for manufacture of sugar and also permission for commencing crushing operations for the year 2008-09 in respect of its Sugar Plant at Podalkur by clearing the statutory dues and arrears of Purchase Tax as arbitrary, illegal, ultravirus the provisions of the Sugar (Control) order, 1966, A.P. Sugar Cane (RS&P) Act, 1961 and in violation of the petitioners rights guaranteed under Art.14 and 19 (1) (g) of the Constitution of India.

2. In view of subsequent developments, the relief sought for in this writ petition does not survive for consideration.

3. Accordingly, the writ petition is dismissed as infructuous. No order as to costs. Miscellaneous petitions, if any pending in this writ petition shall stand closed.
