THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.210 OF 2016 ORDER:

This revision is preferred by the petitioner/A-4 challenging the order, dated 23.12.2015, in Crl.M.P.No.6436 of 2015 in C.C.No.475 of 2015 on the file of the II Additional Judicial Magistrate of First Class, Madanapalle, whereunder and whereby, the petition filed by the complainant praying the trial Court to direct A-3 and A-4 to cause production of their passports and thereby, to seize the same and to keep them in its custody, was allowed.

2. The petitioner is facing trial for the offences punishable under Sections 498-A and 323 I.P.C. and Sections 3 and 4 of the Dowry Prohibition Act, 1961.

3. Heard and perused the material available on record.

4. Learned counsel for the petitioner submitted that the petitioner is ready to surrender the passport after returning from abroad and also informed that he is ready to represent through his counsel before the trial Court.

5. Considering the facts and circumstances of the case, this Criminal Revision Case is disposed of with the following direction: The trial Court is directed to return the passport of the petitioner on his filing an affidavit informing the date of his leaving to abroad and the date of his returning to India and surrendering the passport. Further, the petitioner is directed to represent his case through his counsel on all hearing dates without fail.

6. Miscellaneous petitions pending, if any, in this Criminal Revision Case shall stand closed.
