M.Ravi Kumar v. The State Of Ap., And Another
SMT JUSTI CE T. RAJANI CRI MI NAL PETI TI ON No.4 4 5 9 of 2 0 1 3 ORDER:
This petition is filed seeking for quash of the proceedings against the petitioner, who is accused No.8 in Crime No.343 of 2012 on the file of Narayanaguda Police Station, Hyderabad. 2.
Heard the counsel for the petitioner and the Public prosecutor appearing for the 1st respondent. None appears for the 2nd respondent in spite of notice.
3.
The role of this accused came to light in the confession made by A1. According to the confession of A1, the cheque, in question, was handed over to this petitioner on his promise that he would settle the matter. But since he did not settle the matter, A1 discontinued enquiring with him and later in the month of November, 2012, above cheque, which was given to the petitioner, has been encashed by some one else by impersonating the name as P.V.K.Sastri. Hence, unless the matter is investigated, the truth of the issue would not come to light.
4.
In view of the above, this Court opines that this case is not a fit case for quash.
5.
The Criminal Petition is accordingly dismissed. Interim stay granted by this Court on 04.06.2013 is hereby vacated. As a sequel, the miscellaneous applications, if any pending, shall stand closed.
