HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.9814 OF 2015 O R D E R :

This petition is filed for a writ of Mandamus declaring the action of the Government in issuing memo dated 20.03.2015 which directs the Commissioner of Greater Visakhapatnam Municipal Corporation to go for re-bidding in respect of 'Ultra Modern Shopping Complex' projects as per the prevailing land allotment policy without first negotiating with him who is the successful bidders for the same, is arbitrary, illegal and violative of principles of natural justice.

The grievance of the petitioner is that in pursuance of tender notification dated 26.04.2012, it has participated in the same, but till today no steps have been taken; that the Government issued a memo dated 20.03.2015 advising the 2nd respondent- Greater Visakhapatnam Municipal Corporation to cancel the bids and follow the Government Land Allotment Policy in G.O.Ms.No.571 dated 14.09.2012 and also for rebidding as per the prevailing land allotment policy. Heard the learned counsel for the petitioner, the learned Government Pleader for Municipal Administration appearing for respondent No.1 and Sri S.Laxminarayana Reddy, learned Standing Counsel appearing for respondent No.2. On 22.04.2015, the petitioner sought liberty to file representation to the Government for taking a decision.

Since, its case is kept pending for long time, liberty was granted. Accordingly, the petitioner filed representations on 24.04.2015 and 25.04.2015. Since the representations filed by the petitioner are pending before the Government, it has to consider the same and take a decision. In view of the same, this writ petition is disposed of, directing the 1st respondent to dispose of the representations filed by the petitioner and take action accordingly.

With the above direction, this Writ Petition is disposed of. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ

petition, shall stand closed.
