THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.36064 OF 2016 ORDER:

This writ petition is filed seeking to issue a writ or order more particularly, one in the nature of writ of mandamus to declare the action of the official respondents especially, respondent Nos.2 and 3 in not investigating into Crime No.287 of 2016 on the file of respondent No.3 police station, which was initially registered for the offence under Section 174 Cr.P.C. on 29.8.2016 and thereafter, altered to Sections 498-A and 306 I.P.C. on 31.8.2016, as illegal and arbitrary and consequently, to direct respondent Nos.2 and 3 to investigate into the said crime duly apprehending the unofficial respondent and to act in accordance with law forthwith.

Heard and perused the material available on record. 3.

Admittedly, the case was registered only on 29.8.2016. Hence, this Court is not inclined to give a direction to the official respondents as the writ petition is premature in nature and the same is liable to be dismissed.

Accordingly, the Writ Petition is dismissed. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
