This Writ Petition is filed challenging the action of respondent Nos.3 and 4 in continuing the rowdy sheet opened against the petitioner even though no cases are pending against him.
The petitioner is a resident of Wadi-e-Mustafa, Jalpally, Saroornagar, Ranga Reddy District. He was involved in Crime No.158 of 2002 registered for the offences punishable under Sections 324 and 341 IPC, which was subsequently tried as CC.No.12390 of 2003 on the file of the XIV Chief Metropolitan Magistrate, L.B.Nagar, Saroornagar, and he was acquitted of the said case in the year 2003. Later, another case was registered against him in Crime No.41 of 2003 for the offences punishable under Sections 341, 427, 323 and 290 IPC and the same ended in acquittal in view of compromise on 13-03-2007. In the counter-affidavit filed by respondent No.4, it is stated that the petitioner was involved in a bound over case viz., Crime No.351 of 2010; that apart from the above cases, he was not involved in any crime for the last 6 years; and that in spite of the
ARLR, J WP.No.980 of 2017 Dt: 27.03.2017 same, the rowdy sheet, which was opened against him on 20-05-2005, was decided to be continued till 31-12-2017. This Court time and again held that the rowdy sheet cannot be continued, when no cases are pending against the suspects. In these circumstances, respondent No.3 is directed to pass appropriate orders for closure of the rowdy sheet stated to have been opened against the petitioner within a period of four weeks from the date of receipt of a copy of this order. Subject to the above direction, the Writ Petition is disposed of.
As a sequel to disposal of the Writ Petition, Miscellaneous Petitions, pending if any, stand disposed of as infructuous. _______________________ (A.Ramalingeswara Rao, J) Dt: 27th March, 2017 Note:
