HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.17310 of 2015 ORDER:

Heard the learned counsel for the petitioner and the learned Government Pleader for Civil Supplies. The Writ Petition is being disposed of at the stage of admission with the consent of parties.

The petitioner was appointed as a fair price shop dealer of shop No.8, Pathakotha cheruvu Village, Guntakal Mandal, Anantapur District. While so, the third respondent submitted a report, pursuant to which, a show cause notice dated 04.03.2015 was issued framing five charges against the petitioner. Since the petitioner did not submit his explanation within the time prescribed in the show cause notice, the impugned order of suspension of authorization was passed. Challenging the same, the present Writ Petition is filed. Learned counsel for the petitioner submits that the petitioner submitted his explanation on 19.03.2015 and the charges levelled against him are vague and trivial.

Since, admittedly, the petitioner has submitted his explanation after passing of the impugned order, this Court is not inclined to go into the merits of the case at this stage. However, in view of submission of explanation by the petitioner, the second respondent is directed to complete the enquiry, duly following the principles of natural justice, and pass final orders, within a period of ninety days from the date of receipt of a copy of this order. The Writ Petition is, accordingly, disposed of at the stage of admission. Miscellaneous petitions, if any, pending in this writ petition shall stand disposed of. No order as to costs.
