THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL REVISION CASE No.1521 OF 2008 ORDER:

This Criminal Revision Case is filed under Sections 397 and 401 of Cr.P.C challenging the judgment dated 29.09.2008 passed in Crl.M.P.No.114 of 2007 in S.C.No.207 of 2004 on the file of the Court of the Assistant Sessions Judge, Kadapa. At the time of arguments, the learned counsel for the petitioners has sought permission of the Court to permit the petitioners to withdraw this case, with liberty to urge the points raised in this Revision Case before the trial Court at the time of trial. He further requested that the presence of the petitioners / A.5, A.7 and A.8 before the trial Court may be dispensed with on each and every date of adjournment. There is no dispute with the regard to the identity of the petitioners, who are accused Nos.5, 7 and 8 in the case. Even if the presence of the petitioners / A.5, A.7 and A.8 is dispensed with, no prejudice will be caused to the 2nd respondent.

In the result, the Criminal Revision Case is dismissed, granting the liberty as prayed for. The presence of the petitioners who are accused Nos.5, 7 and 8 in S.C.No.207 of 2004 on the file of the Court of the Assistant Sessions Judge, Kadapa is dispensed with on each and every date of adjournment. However, they shall appear before the trial

Court as and when their presence is so required. As a sequel, the miscellaneous petitions, pending if any in this Criminal Revision Case, shall stand closed.
