ORDER:
This writ petition is filed challenging the action of respondents 2 to 6 in in seeking to dispossess the petitioner by digging the petitioner's land in Sy.No.131 admeasuring Ac.12.15 guntas and Sy.No.132 admeasuring Ac.0.10 guntas situated at janwada Village, Shankarpally Mandal, Ranga Reddy District under the guise of excavating irrigation Tank under Mission Kakatiya Programme without following due process of law and without initiating land acquisition proceedings.
The case of the petitioner is that he is the absolute owner and possessor of land in Sy.Nos.131 & 132, totaling to Ac.12.25 gts situated in Janwada Village, Shankarpally Mandal, Ranga Reddy District, having inherited the same through his father under Will deed dated 12.10.1998. The grievance of the petitioner is that the respondents without any right over the land, have came to the petitioner's land on 2.04.2016 and started digging his land under the guise of excavating irrigation Tank under Mission Kakatiya Programme, without following due process of law. Learned counsel for the petitioner places reliance on the order dated 08.02.2016 passed by this Court in W.P.M.P.No.4780 of 2016 in W.P.No.3741 of 2016. In that view of the matter, I deem it appropriate to direct the respondents not to dispossess the petitioner from his land in Sy.Nos.131 and 132 totaling to Ac.12.25 guntas without following due
process of law and without paying due compensation to him. With the above direction the writ petition is disposed of. As a sequel, Miscellaneous Petitions pending, if any, shall stand closed. No order as to costs.
