THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 780 OF 2017 O R D E R :

This Writ Petition is filed questioning the action of the 3rd respondent Assistant Director, Mines & Geology, Medak District in not considering the Petition filed by the petitioners on 31.12.2016 objecting granting of permission to conduct quarry operations in Survey Nos. 120 to 126 (20, 20, 7.8) situated at Gopalakrishnapuram H/o Hakimpet Village, Yeldurthy Mandal, Medak District in favour of Respondents 7 and 8. Learned Government Pleader for Mines & Geology (Telangana), based on the written instructions, would submit that the 3rd respondent, after obtaining 'No Objection Certificate' from the Tahsildar, Yeldurthy Mandal, has already sent proposals dated 07.12.2016 to the Director of Mines & Geology for grant of quarry lease over an extent of 7.360 Hectares in Survey No. 120 of Hakeempet Village, Yeldurthy Mandal in favour of M/s United Mineral Corporation, rep. by its Managing Partner Sri Mohd. Muqtadir Khan for a period of twenty years under Rule 12(5) of the TSMMC Rules, 1966.

In view of the submission made by the learned Government Pleader that the lease has already been granted in favour of a third party, the grievance set out in this Writ Petition need not be entertained. Accordingly, it is dismissed as infructuous, however, leaving liberty to the petitioners to work out their remedies in accordance with law. No costs.

Consequently, the miscellaneous Applications, if any shall also stand dismissed.
