HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.7890 of 2002 ORDER:

This writ petition is filed seeking a direction to absorb the petitioner as Junior Assistant on compassionate grounds.

The grievance of the petitioner is that his father was employed with the respondents and retired on medical invalidation grounds, and the respondents were pleased to appoint the petitioner as Assistant on temporary basis, but not as Junior Assistant on permanent basis. Therefore, the present writ petition is filed seeking a direction to the respondents to appoint/absorb the petitioner as Junior Assistant on permanent basis instead of Assistant on temporary basis. The respondents, in the counter, contended that at the relevant point of time, as there were no vacancies in the cadre of Junior Assistant, the petitioner was appointed as Assistant on temporary basis.

This Court, having considered the rival submissions of the parties, is of the considered view that this writ petition can be disposed of directing the petitioner to submit a fresh representation seeking absorption as Junior Assistant against a regular vacancy, if not already done, within a period of two weeks from the date of receipt of a copy of this order, and upon such representation being received, the respondents shall consider the same and pass appropriate orders in accordance with law in another Eight weeks thereafter. With these observations, the writ petition is disposed of. No order as to costs.
