THE HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No.37972 OF 2016 ORDER:

The petitioner challenges the proceedings dated 24.09.2016. The petitioner raised several contentions in the writ petition against the said proceedings.

A bare perusal of the said proceedings would show that it is a show cause notice calling upon the petitioner to submit his explanation as to why action should not be taken against him on the allegation of illegal construction being made by him. 3.

Since the impugned proceedings are only a notice, the petitioner ought to have responded to the said notice and nothing prevented him from raising all the contentions that are urged in the writ petition. Therefore, this Court is not inclined to entertain the Writ Petition.

However, the petitioner is given liberty to file his explanation, if so advised, to the impugned show cause notice within a period of two (2) weeks from today. If such an explanation is filed by the petitioner within the time prescribed, the competent authority of the respondent Corporation shall consider and pass a reasoned order before taking any recourse against the petitioner. The respondent shall also provide the opportunity of personal hearing to the petitioner and permit him to produce all the documents in support of his claim. If action has already been taken in pursuance of the impugned notice, both the parties are

directed to maintain status quo obtaining as on today till the final orders are passed, as directed above.

With the above directions, this Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, filed in this Writ Petition shall stand closed.
