THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.8234 of 2018 ORDER:

The petitioners state that they are the owners and possessors of agricultural land of an extent of Ac.1.35 guntas in Survey No.822 situated at Dubbak Village and Mandal, Siddipet District. They claim to have inherited the said property from their father, who was the assignee of the said land assigned in the year 1978. He died in the year 1996 and thereafter the petitioners have continued to be in possession of the said property. The petitioners applied for mutation of their names in the revenue records and when the application is pending, it is stated that the contractors who constructed double bedroom houses on commercial basis in the neighbouring land are influencing the revenue authorities to cancel the patta issued in favour of the petitioners' father in 1978. They state that they are surviving on the said land of an extent of Ac.1.35 guntas and they also state that they submitted the representation on 20.02.2018 to the third respondent not to cancel the patta and when no communication was received from the respondents, the present Writ Petition is filed.

A reading of the above events clearly shows that the present Writ Petition is filed on a mere apprehension. There was no need for the petitioners to submit the representation not to cancel the patta, when no notice was issued by the fourth respondent. We cannot assume that the fourth respondent will

not follow the due procedure of law if he wants to cancel the assignment patta issued in favour of the petitioners' father way back in 1978.

In the circumstances, this Court sees no ground to entertain the present Writ Petition, and the same is, accordingly, dismissed. However, it is open to the petitioners to come to this Court or avail the alternative remedy as and when a fresh cause of action arises. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs.
