ORDER

This petition under Section 482 Cr.P.C. is filed by the petitioner/A3 seeking to quash the proceedings in Cr.No.89 of 2015 of Tadepalligudem Town Police Station, West Godavari District, registered for the offence punishable under Section 420 IPC and under Sections 3 and 7 r/w.56(2) of A.,P.Chit Funds Act, 1971, against him.

2. It is alleged in the complaint that the de facto complainants were participated in the chits conducted by the accused in the name and style of Ratna Balaji Chit Fund Private Limited and A1 collected chit amounts in installments and thereafter, the accused cheated them by not paying the chit amounts. Based on the complaint, the aforesaid crime was registered against the accused.

3. As per the complaint, there are no serious allegations against the petitioner/A3. But, truth or otherwise of the allegations made in the complaint can be ascertained by the investigating agency during the course of investigation. Therefore, this Court is not inclined to interfere with the impugned proceedings. However, the concerned police are directed to complete the investigation without arresting the petitioner/A3 and file a final report, if any, in accordance with law. The petitioner/A3 is directed to appear before the investigating agency as and when required and cooperate with the investigating agency.

4. With the above direction, the Criminal Petition is disposed

of. Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
