HON'BLE SRI JUSTICE SURESH KUMAR KAIT AND HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI W.P.Nos.11905 & 22838 OF 2003 COMMON ORDER: (ORAL) (per Hon'ble Sri Justice Suresh Kumar Kait) As the issue involved in these two writ petitions is one and the same, these matters are taken up together for disposal by this Common Order.
2. Feeling aggrieved by the common order dated 07.02.2003 to the extent it pertains to O.A.Nos.1647 of 2003 & 1644 of 2003 on the file of Central Administrative Tribunal, Hyderabad Bench (for short "the Tribunal") the applicants therein filed these two writ petitions.
3. As stated by the learned counsel for the petitioners that the common order dated 07.02.2003 was challenged by another applicants in W.P.No.8246 of 2003 before this Court and the same was allowed vide order dated 14.09.2003. Thus the present writ petitions are squarely covered by the aforesaid judgment of this Court.
4. Learned counsel appearing on behalf of the respondents does not dispute the submissions made by the learned counsel for the petitioners.
5. Keeping in view the fact that the issue raised in the present writ petitions has already been decided by this Court
SKK,J & AKS,J WP Nos.11905& 22838 of 2003 in W.P No.8246 of 2003 vide its order dated 14.09.2003. Therefore, we hereby, while confirming the findings of the Tribunal contained in para-32 and the concluding portions of the order impugned in these writ petitions, the result portion of the said order is modified by allowing the O.A.
6. It is needless to observe that the petitioners are entitled to revised pay scales reckoning from the date on which they have acquired the qualification of Diploma in Draughtsman.
7. These Writ Petitions are accordingly allowed. There shall be no order as to costs.
Miscellaneous Petitions, if any pending, shall stand closed.
