Francina Salathe Mary v. Solem Sathemma
THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI CIVIL REVISION PETITION No.4871 of 2015 ORDER:- Feeling aggrieved that the interlocutory application in I.A.No.125 of 2015 in O.S.No.36 of 2015 on the file of the learned Agent to Government, Khammam is not being disposed of in accordance with the procedure established by law though sufficient period of time had elapsed from the institution of the said application, the present revision petition is filed requesting to direct the said learned authority to dispose of the said application within a reasonable time. I have heard the submissions of the leaned counsel for the revision petitioners/plaintiffs in the said suit and I have perused the material record.
The learned counsel for the revision petitioners would submit that the office of the authority concerned had also issued notice to the opposite parties in the aforementioned interlocutory application fixing the date 29.08.2015 for appearance but, later the said interlocutory application was not disposed of on merits. He would also submit that the present learned Agent to Government is taking up the matters on day-today basis and that therefore, this revision petition may be disposed of giving a direction to the said learned authority to fix a date and dispose of the interlocutory application within a reasonable time and in accordance with the procedure established by law.
Recording the said submission of the learned counsel for the revision petitioners, this Civil Revision Petition is disposed of directing the learned Agent to Government/District Collector, Khammam District to dispose of I.A.No.125 of 2015 in O.S.No.36 of 2015 within reasonable time and in accordance with the procedure established by law. There shall be no order as to costs.
Miscellaneous petitions pending, if any, in this civil revision petition, shall stand closed.
