HON'BLE SRI JUSTICE U.DURGA PRASAD RAO WRIT PETITION No.12885 OF 2012 ORDER:

This writ petition is filed by the petitioner under Article 226 of the Constitution of India seeking a writ of mandamus declaring the action of 3rd respondent in not finalizing investigation in Crime No.77 of 2012 of Markapur Town Police Station, Prakasam District, by arresting the accused and seizing their passports and not filing charge sheet against the accused as illegal, irregular and violative of Article 14 of the Constitution of India and for other prayers.

When the matter came up for hearing today, learned Government Pleader for Home, on instructions from the 3rd respondent, would submit that in this case charge sheet was filed by the investigating officer before learned Additional Judicial Magistrate of First Class, Markapur, on 07.03.2013, which was taken cognizance and registered as P.R.C.No.19 of 2013.

In view of the above submission, the subject matter in this writ petition has become infructuous and accordingly, the writ petition is dismissed as infructuous. As a sequel, miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
