THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.1713 OF 2016 ORDER:

Heard the learned counsel for the petitioner and the learned Government Pleader for Revenue.

2. The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the Joint Collector in not finally disposing of the revision filed by the 7th respondent pertaining to land to an extent of Ac.5-90 cents in survey No.372/3 in Rayapudi Revenue Village, Tullur Mandal, Guntur District, as arbitrary and illegal and consequently, direct the Joint Collector to finally dismiss the Revenue Petition RC.No.5844 of 2015-D5 filed by the 7th defendant declaring that there are no grounds for it to be sustained.

3. Heard and perused the material on record.

4. By an order, dated 22.01.2016, this Court while issuing notice to the respondents held as follows:

"The operative portion of the impugned order, wherein the Joint Collector directed the Tahsildar to implement the orders immediately and send all the connected records, pending revision, is suspended for a period of three (03) week. However, the Joint Collector shall proceed further with the hearing of the main revision and dispose of the same as expeditiously as possible, in accordance with law."

5. Respondent No.7 filed counter denying the averments made in the affidavit filed in support of the petition and stated that he has no objection for disposal of the revision.

6. Without going into the merits of the case and having regard to the facts and circumstances stated above, the Writ Petition is disposed of directing the Joint Collector to dispose of the revision petition vide RC.No.5844/2015-D5 filed against the order of Revenue Divisional Officer in R.C.No.5103/2012-A, dated 12.12.2015, as early as possible, preferably within a period of three (3) months from the date of receipt of a copy of this order. Till such time, the order of the Joint Collector, dated 12.12.2015, directing the Tahsildar to implement the orders immediately shall stand suspended. There shall be no order as to costs. Miscellaneous petitions, if any, pending shall stand closed.
