HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN Writ Petition No.8579 of 2011 ORDER:

Condition 13 of the auction notice dated 25.03.2011, which stipulates the eligibility condition for participation in the public auction for conferring leasehold rights for collecting fees on the sandy market for the year 2011-12, is questioned in this Writ Petition as being arbitrary and illegal.

In the counter-affidavit it is stated that the Gram Panchayat had entered into an agreement with one Mr.Vadiya Seena for collecting fees on the sandy market for the period from 09.04.2011 to 31.03.2012. The very period for which the auction was held, for grant of leasehold rights relating to the year 2011-12, expired more than five years ago. It is evident that the cause in the Writ Petition does not survive necessitating any further adjudication by this Court; and the Writ Petition has become infructuous. The Writ Petition is, accordingly, dismissed as infructuous. The Miscellaneous Petitions pending, if any, shall also stand dismissed. No order as to costs.
