HONOURABLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No. 27102 of 2015 ORDER:
Heard learned Counsel for the petitioner and learned Government Pleader for the respondents.
The petitioner is carrying on business in edible oils in the name and style of M/s. Lakshmi Distributors having obtained licence from the competent authority . While so, the third respondent inspected the business premises of the petitioner on 03.08.2015 and seized some stock worth of Rs.8,51,520/- on the ground of noticing irregularity of not having storage licence to carryon oil business. The petitioner states that he started the business only in the month of June, 2015. The petitioner is stated to have filed an objection petition before the second respondent on 17.08.2015 for release of the seized stock. When no orders are passed on the said petition, the present Writ Petition is filed.
From the narration of above facts, it is clear that 6-A proceedings initiated against the petitioner pursuant to the inspection made on 3.8.2015 are pending consideration before the second respondent. The seized stock is edible oil which is not a perishable commodity. The petitioner is not seeking release of the seized stock. In the circumstances, the second respondent is directed to complete the enquiry in respect of the irregularities alleged against the petitioner and pass final order within sixty days from the date of receipt of a copy of this order after affording due opportunity to the petitioner. Till then, the
seized stock shall not be sold to any third parties. Subject to the above, the Writ Petition is disposed of. Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
