THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION No.8889 of 2017 ORDER:

This Criminal Petition, under Section 482 Cr.P.C., is filed by the petitioners/ A.1 to A.6, to quash the proceedings in C.C.No.473 of 2015 on the file of Additional Judicial First Class Magistrate, Markapur, Prakasam District, on various grounds.

During hearing Sri V. Ganesh Bhujanga Rao, learned counsel for the petitioners, requested this Court to dispense with the appearance of petitioners on the date of adjournments since the Docket Sheet relating to C.C.No.473 of 2005 shows that the de facto complainant is not cooperating with the Court for disposal of the case. But, such Order cannot be passed by this Court since it is the discretion of the Magistrate concerned under Section 205 Cr.P.C. Therefore, the petitioners are permitted to file appropriate application under Section 205 Cr.P.C., or under Rule 37 of Code of Criminal Procedure Code, before the trial Court. On filing of such application, the trial Court is directed to dispose of the application in accordance with law. Further, the trial Court is directed to dispose of the main case, as expeditiously as possible in any event not later than six months, from the date of receipt of a copy of this Order. With the above direction, this Criminal Petition is disposed of. Consequently, miscellaneous applications pending, if any, shall also stand dismissed.
