HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.8303 OF 2018 O R D E R :

Learned Standing Counsel for respondents 1 to 3 on instructions submits that the impugned charge memo dated 16.02.2018 is withdrawn and in its place a fresh charge memo dated 16.03.2018 was issued to the petitioner in pursuance to the preliminary enquiry and petitioner can submit his explanation. He also produced the copy of the fresh charge memo. He further states that if respondent authorities are satisfied with the explanation, they will close the case, otherwise, they will initiate disciplinary proceedings.

Though learned counsel for the petitioner states that straightaway, the respondent authorities are taking action on the basis of preliminary report, but, in view of the aforesaid submission of the learned Standing Counsel, the writ petition is disposed of recording the same. The petitioner is permitted to file explanation within four weeks from today. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
