HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.8254 OF 2018 O R D E R :

The case of the petitioner is that he filed writ petition No.26606 of 2017 challenging the order dated 01.08.2017 passed by the 2nd respondent dismissing the petitioner from service and the said writ petition was allowed by order dated 16.08.2017.

Thereafter, he filed representation dated 30.08.2017 along with a copy of the order in the said writ petition. After three months, the 2nd respondent issued proceedings admitting the petitioner to duty with effect from 01.09.2017 as per the orders dated 18.12.2017. Thereafter, the 2nd respondent addressed letter dated 20.02.2018 informing the 3rd respondent that the petitioner's joining report was accepted and admitted w.e.f. 01.09.2017 and his services as Office Subordinate have been utilized in Revenue Department on deputation basis, subject to reimbursement of salaries and attached to Administrative Officer, Mee Seva Branch, Collectorate, Nalgonda; and also requested to release pay and allowance of the petitioner to till date from 01.09.2017. Despite said letter, no action has been taken for payment of salary to the petitioner. Aggrieved by the same, present writ petition is filed.

Heard learned counsel for the petitioner.

Limited, produced written instructions dated 17.03.2018, wherein it is stated as follows;

"In view of the above, the salary of the incumbent for the duty period will be released after receiving original duty certificate issued by District Revenue Officer, Nalgonda, since it is not received from official Mail ID of DRO/District Collector, Nalgonda, to treat it as authenticated. The PD(H), Nalgonda was requested to obtain the original duty certificate from the DRO. He has promised to send the same by 19.03.2018. On receipt of the original duty certificate salary will be paid to individual as per the certificate."

In view of the above, the competent authority is directed to take steps for payment of salary to the petitioner, in accordance with rules, within a period of three months from the receipt of a copy of this order.

Accordingly, the writ petition is disposed of. No order as to costs.
