The Commissioner, v. Labour Court--Iii, Hyderabad,
HON'BLE SRI JUSTICE S.V.BHATT W.P. Nos.3742, 3750_AND 3758_OF 2003 COMMON ORDER:
The Commissioner, Mahaboobnagar Municipality, Mahaboobnagar is the writ petitioner in these three cases. The private respondents are working in Mahaboobnagar Municipality. The writ petitions are filed against the orders passed by the 1st respondent in M.P Nos.41/ 93, 7/ 96 and 49/ 93 dated 18.09.2001 filed under Section 33C(2) of the Industrial Disputes Act, 1947. The counsel for respondents relies upon the decision in Rajendranagar Municipality rep. by its Commissioner v. B.V.Perraju & Others1 confirmed by a Division Bench of this Court in W.A.No.793 of 1995 and also the latest decision of the Apex Court in State of Punjab v. Jagjit Singh2 and submits that the relief granted by the 1st respondent is valid, legal and no exception can be taken. Mr.
Praveen does not dispute the applicability of the decisions referred to above to the fact situation of the case. I have perused the orders impugned in the writ petitions and having regard to the nature of dispute, issue framed by the 1st respondent, evidence brought on record by the parties, no exception to the findings recorded by the 1st respondent is pointed out. The grounds urged by the petitioner do not attract the scope of judicial review. As no other point is urged, the writ petitions fail and accordingly dismissed. No order as to costs.
Miscellaneous petitions pending, if any, shall stand closed. ___________ S.V.BHATT,J Date:09.02.2017 Stp
