HON'BLE SRI JUSTICE A. RAJASHEKER REDDY CONTEMPT CASE No.663 of 2018 ORDER :
This contempt case, under Sections 10 to 12 of the Contempt of Courts Act, has been filed by the petitioner alleging violation of interim order dt.06.03.2017 passed by this Court in W.P.No.7427 of 2017.
By the aforesaid order dt.06.03.2017, this Court granted interim stay of all further proceedings pursuant to the impugned order dt.26.10.2015 in Procs.No.D/3525/2015 issued by respondent No.4 so far as the land admeasuring Acs.4.00 in Sy.Nos.236 and 237, Khatha No.1158, situated at Srinagar Village, Maheshwaram Mandal, Ranga Reddy District.
The case of the petitioner is that though the aforesaid interim order was served on the respondent herein on 08.03.2017, the respondent has issued proceedings in Case No.B/739/2016, dt.14.03.2017, which is in violation of the aforesaid interim order passed by this Court. Counter affidavit is filed by the respondent herein stating that the aforesaid interim order passed by this Court was served on the respondent on 17.03.2017, after issuance of the proceedings dt.14.03.2017 by the respondent.
ARR,J C.C.No.663 of 2018 No reply affidavit is filed by the petitioner disputing the same.
Though learned counsel for the petitioner submits that there is a seal of office of the respondent, there is no endorsement on the same. On the other hand, the learned Government Pleader appearing for the respondent has produced a copy of endorsement made by the respondent's office regarding receipt of interim order passed by this Court, which goes to show that even before the aforesaid interim order reached the office of respondent on 17.03.2017, the respondent has issued the proceedings dt.14.03.2017. Therefore, I do not see any violation of the orders passed by this Court.
Accordingly, the contempt case is dismissed and the presence of the respondent is dispensed with. However, the petitioner can raise all these pleas in the main writ petition, which is pending before this Court. No order as to costs. __________________________ A. RAJASHEKER REDDY, J 07.06.2019.
