O R D E R

The grievance of the petitioner was that the police authorities had opened a rowdy sheet in his name on the file of the II Town Police Station, Anantapur, and were continuing the same despite closure of all the cases pending against him.

The Sub-Inspector of Police, II Town Police Station, Anantapur, filed a counter-affidavit stating that the petitioner was involved in nine criminal cases between the years 1995 and 2012 and due to his involvement in such criminal activity, a rowdy sheet had been opened in his name. He however conceded that after the petitioner was bound over in M.C.No.59 of 2012 in May, 2012, no other case had been registered against him either in Rapthadu Police Station or in the II Town Police Station at Anantapur. He concluded by stating that it was open to the petitioner to make a representation to the concerned authorities after completion of the bound over period and that the said representation would be considered at that stage in accordance with law.

Sri Ganduri Nageswara Rao, learned counsel for the petitioner, informed this Court that the petitioner did, in fact, make a representation on 12.09.2014 to the Deputy Superintendent of Police, Anantapur, asking for closure of the rowdy sheet opened in his name. The stamp of the office of the Deputy Superintendent of Police, Anantapur, affixed on the said representation evidences that it was received on 23.11.2014. In that view of the matter, the writ petition is disposed of directing the Superintendent of Police, Anantapur, to call for and consider the petitioner's representation dated 12.09.

The Superintendent of Police, Anantapur, shall examine as to whether the petitioner was involved in any criminal activity after the year 2012 and whether the maintenance of a rowdy sheet in his name is still warranted on facts and as per regulations. This exercise shall be completed expeditiously and in any event, not later than four weeks from the date of receipt of a copy of this order.
