ORDER:
This Criminal Petition is filed before this Court for grant of pre-arrest bail to the petitioner who is arrayed as accused in Crime No.164 of 2026 of Banjara Hills Police Station, Hyderabad, registered for the offences punishable under Section 69 of the Bharatiya Nyaya Sanhita, 2023 (for short 'BNS').

The brief facts of the case are that, on 20.06.2024, the de-facto complainant lodged a report before the police stating that the accused Attesham Mohammed, since 2019, engaged in persistent stalking, monitoring, and intrusive conduct despite her clear refusal. The accused unlawfully hacked her mobile phone since 20.09.2024, tracked her movements, and on 20.10.2024 threatened her sister with leakage of morphed photographs unless she met him. On 29.10.2024, the accused visited her residence and used abusive language, creating fear in the household and on 31.10.2024, under threats of exposing morphed photographs, she was allegedly restrained, assaulted, and forcibly raped by the accused and an amount of Rs.3,50,000/- was extorted under the pretext of dowry and promised marriage.
Thereafter, sexual intercourse was repeatedly obtained under false assurance of marriage, totaling Rs.7,14,470/- extorted via cash and online transfers. On 07.11.2025, the accused denied marriage and claimed political immunity and threatened to kill her and daughter. Hence, the complainant requested to take necessary action.
on the said complaint, the police registered a case against the petitioner for the aforementioned offences. 3.

Sudhaker, learned counsel appearing on behalf of the petitioner as well as Sri M. Ramachandra Reddy, learned Additional Public Prosecutor for respondent-State.

Learned counsel for the petitioner submitted that the relationship between the petitioner and the de-facto complainant was consensual in nature and that there is no such promise of marriage made by the petitioner. Earlier, the de-facto complainant has lodged an FIR No.1234 of 2025 dated 10.11.2025 i.e., only for the purpose her hacking of cell phone, but she did not mention about the incident dated 31.10.2024 in the FIR dated 10.11.2025, which itself shows that the present Criminal Case is registered only to harass the petitioner with false allegations. It is further submitted that the petitioner is ready to co-operate with the investigating authority. Therefore, he prayed the Court to grant bail to the petitioner by allowing this criminal petition.

On the other hand, learned Addl. Public Prosecutor opposing the petition stating that the alleged offences are grievous and heinous in nature and the material part of the investigation is not yet completed. It is further contended that the custodial interrogation of the petition is required. Therefore, he prayed the Court to dismiss the petition.

In the light of the submissions made by both the learned counsel and upon perusal of the material available on record and considering the facts and circumstances of the case, the nature of the allegations, the stage of investigation, and the duration of incarceration and also considering the allegations in the present FIR dated 21.02.2026 and the allegations in the earlier FIR dated 10.11.2025 registered by the de-facto complainant, this Court deems it fit to grant pre-arrest bail to the petitioner, subject to compliance of the following conditions:s i.
The petitioner shall surrender before the Station House Officer, Banjara Hills Police Station,
Hyderabad, within two weeks from today, and on such surrender, the said Station House Officer shall release him on bail, on petitioner executing a personal bond for Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties, for the like sum each.
ii.
The petitioner shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and cooperate with the Investigating Officer in investigating the case.
iii.
The petitioner shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m, and 05:00 p.m., till the filing of the charge sheet and thereafter, as and when required.

Accordingly, the Criminal petition is allowed.
Miscellaneous applications, if any pending, shall stand closed.
