B. Udaya Lakshmi v. The State Of Telangana
Date: 1.10.2019 Between :
B.Udayalakshmi Petitioner And State of Telangana, rep. by its Principal Secretary to Government, Women Development and Child Welfare Dept., Secretariat, Hyderabad and another.
Respondents This court made the following :
ORDER:
This writ petition is filed declaring the action of the respondents in not settling pension and pensionary benefits along with interest accrued payable to the petitioner as illegal. 2.
The learned Government Pleader filed a letter dated 23.9.2019 into the registry stating that the relief prayed by the petitioner has been granted by the Government vide G.O.Rt.No.141 dated 6.6.2016 releasing pensionary benefits of the petitioner. 3.
A perusal of G.O.Rt.No.141 dated 6.6.2016 discloses that the Government dropped further disciplinary proceedings against the petitioner and released her pensionary benefits. 4.
Insofar as interest on the pensionary benefits is concerned, the learned counsel for petitioner fairly submits that the Government passed orders closing disciplinary proceedings, but on account of pending disciplinary proceedings, petitioner was not paid pension when it was due and therefore, she is entitled to interest on delayed payment.
5.
In this writ petition, as the petitioner has not challenged the disciplinary proceedings, which ultimately ended on 6.6.2016, this Court cannot go into that aspect. Leaving it open to the petitioner to work out her remedies as available under law on the issue of payment of interest for the period prior to 6.6.2016, this writ petition is dismissed. As a sequel, the miscellaneous petitions, if any, shall stand closed.
