ORDER:

Assailing the validity of notice bearing No.G03/UC/ACP.6/60/GHMC/2015, dated 17.10.2015, issued under Section 636 of the Greater Hyderabad Municipal Corporation Act, 1955 by respondent No.1, the petitioner filed this writ petition. At the hearing, Sri C.Subodh, learned counsel for the petitioner, submitted that as per the recent building penalisation scheme, his client has submitted his application for regularisation of the constructions made by him and that therefore, the impugned notice cannot be enforced till a decision is taken on the said application. On 03.12.2015, Sri N.Rishi Kumar, learned counsel, representing Sri N.Ashok Kumar, learned Standing Counsel for respondent No.1, requested for an adjournment for instructions on the above mentioned plea of the petitioner and accordingly, the case has

been adjourned to today. Today, at the hearing, the learned counsel appearing for the respondents submitted that the petitioner has applied for regularisation of the illegal constructions on 02.12.2015 and that the same is under consideration.

In the light of this fact, the respondents are directed to consider the petitioner's application for regularisation, take a decision and communicate the same to the petitioner within a period of two weeks from the date of receipt of a copy of this order. Further action in pursuance of the impugned notice shall depend upon the decision that may be taken by the respondents on the application filed by the petitioner for regularisation.

Subject to the above directions, the writ petition is disposed of. As a sequel to disposal of the writ petition, WP.M.P.Nos.44760 & 47843 of 2015 shall stand disposed of as infructuous. C.V.NAGARJUNA REDDY, J 04th December, 2015 VGB
