HON'BLE Dr. JUSTICE CHILLAKUR SUMALATHA CRIMINAL REVISION CASE No.199 of 2022 ORDER:

Challenge in this Criminal Revision Case is the order that is rendered by the Court of IX Additional Sessions Judge at Kamareddy in Crl.A.No.23 of 2021 dated 24.01.2022.

Heard the submission of learned Assistant Public Prosecutor who is representing the petitioner and also the learned counsel for the respondent.

Learned Assistant Public Prosecutor submits that while releasing the vehicle in question by the Court of IX Additional Sessions Judge at Kamareddy, the conditions imposed are inadequate and therefore, the present revision case is filed.

The operative portion of the impugned order is as under:

In the result, the appeal is allowed by setting aside the orders dt.11.10.2021 passed by the Forest Divisional Officer-cum-Authorized Officer, Kamareddy, in proceedings No.2728/2021/S6, POR No.46/293 dt. 06.08.2021 and the respondent forest officials are directed to return the Tractor bearing No.AP-31-CB-9006 to the appellant on his furnishing one surety for Rs.5,00,000/- (Rs. Five lakh only) and further he has to give an undertaking that he will not alienate or change the physical features of the vehicle and he shall produce the vehicle as and when directed by the Judl. Magistrate of First Class, Kamareddy, pending disposal of POR No.46/293 dt.

06.08.2021 filed by the Forest department."

This Court does not find any infirmity in the impugned order or that the conditions imposed are inadequate. Also this Court does not find any other grounds so as to interfere with the said reasoned order. Therefore, this Court holds that the revision petition lacks merits.

Resultantly, the Criminal Revision Case is dismissed. Having regard to the submission of the learned counsel for the respondent that the vehicle is in the custody of the Forest Department since long time, the Authorized Officer i.e., the Forest Divisional Officer, Kamareddy, is directed to

Dr.CSL,J Crl.R.C.No.199 of 2022 release the vehicle forthwith on the respondent complying required conditions.

As a sequel thereto, miscellaneous petitions pending, if any, shall stand closed.
