HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 15473 of 2002 ORDER:
This writ petition is filed seeking to issue a writ of mandamus declaring the action of the respondents in recovering penal interest from the salaries of the petitioners, during the period from July 1995 to October, 1997 to the tune of Rs.27,980/- and Rs.26,236/- respectively from the petitioners, as illegal and arbitrary. A consequential direction is also sought to the respondents not to recover the said amounts from the salaries of the petitioners respectively.
While admitting the writ petition, this Court granted interim direction to the respondents not to recover the monthly installments from the salaries of the petitioners vide orders dated 21.08.2002 in WPMP No.19385 of 2002.
When the matter is taken up for hearing, learned counsel for the petitioner submits that during pendency of the writ petition, the 1st petitioner has retired from service on attaining the age of superannuation.
Learned standing counsel for the respondents has contended that in view of the interim orders, no further orders are necessary in the writ petition.
In view of the above, the writ petition is closed. Consequently, miscellaneous petitions, if any, pending in the writ petition shall stand closed. No order as to costs.
