THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.38455 of 2016 ORDER:

This writ petition is filed seeking to declare the inaction of the 4th respondent in not-registration of the crime on petitioner's report, dated 28.08.2016, 30.08.2016, 10.10.2016, 02.11.2016, submitted to the 4th respondent for investigation, as illegal and arbitrary and consequently to direct the respondents to register crime on petitioner's reports and complete investigation within a time frame.

Heard and perused the material available on record. The main grievance of the petitioner is that the petitioner and his family members purchased land in an extent of Ac. 0.30 cents in Survey No.202/3 of Parempudi Revenue of Koyyalagudem Village, West Godavari, vide five different documents on 22.05.2006 and that the 5th respondent, resident of the same village colluding with the petitioner's vendors and created a document, dated 14.06.2016, subsequent to their sale transaction and started troubling the petitioner for dispossession. The 5th respondent by engaging the third parties on hire, is threatening the petitioner to dispossess him from his site. The petitioner made written complaints to the 4th respondent on 28.08.2016, 30.08.2016, 10.10.2016 & 02.11.2016, but the 4th respondent is not taking any action against the 5th respondent.

Considering the grievance of the petitioner, the 4th respondent is directed to register a case against the 5th respondent, if the complaints lodged by the petitioner, dated 28.08.2016, 30.08.2016, 10.10.2016 & 02.11.2016, discloses any cognizable offence and investigate into the same and file a final report if any. If the petitioner is aggrieved by the action of the 4th respondent, he is at liberty to approach the superior

officer of 4th respondent and also to approach the concerned Court by invoking provision under Section 200 Cr.P.C.

Accordingly, the Writ Petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. ___________________ RAJA ELANGO,J Date: 9th November, 2016 KL
