THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.23755 OF 2012 ORDER:
This writ petition is filed seeking to issue an order or direction more particularly, one in the nature of writ of Mandamus to declare the action of the respondents in not taking action on the petitioner's complaint, dated 24.7.2012, against the illegal occupation of Gram Panchayat's land and construction of a building and erection of statue without permission from Gram Panchayat, as per Rule 14 of the Andhra Pradesh Gram Panchayat Land Development (Lay Out and Building) Rules, 2002, as illegal and arbitrary, and consequently, to direct the respondents to take action to remove the said illegal structure and statue.
2. Case of the petitioner is that some villagers of Munipally, who are said to be the followers of late Dr.Y.S.Rajasekhar Reddy, are constructing a building and erecting a statue in the Gram Panchayat land without obtaining permission from the Gram Panchayat. Petitioner along with others made complaints to the respondents on 17.7.2012, 18.7.2012 and 24.7.2012, but no action has been taken. Hence, he filed the present writ petition.

Counter-affidavit is filed by respondent No.1 stating that the followers of late Dr.Y.S.Rajasekhar Reddy stopped the installation of statue in the Gram Panchayat limits and at present, there is no such proposal for installation of the statue. It is further stated that since the proposed installation of the statue is not in accordance with G.O.Ms.No.55 TR R & B Department, dated 8.4.2003, it is informed to the said followers to stop the installation of the statue and they themselves stopped the installation of the statue and hence, prayed to dismiss the writ petition.
4. Heard Sri S.Satyam Reddy, learned counsel for the petitioner, Sri G.Narender Reddy, learned Standing Counsel for respondent No.1, and the learned Government
Pleader for Panchayat Raj and Rural Development (Telangana State) appearing for respondent Nos.2 to 4.
5. In view of the assertion made in the counter-affidavit of respondent No.1 that the installation of statue was stopped, the grievance of the writ petitioner stood redressed.
6. Accordingly, the Writ Petition is disposed of in terms of the counter-affidavit of respondent No.1. There shall be no order as to costs.
