THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No. 14272 of 2015 ORDER:
Heard learned counsel for the petitioner and learned Government Pleader for the respondents.
2. The petitioner was appointed as a Fair Price Shop Dealer of Shop No.19 of Gurrampadu Village, Chennur Mandal, YSR Kadapa District. While so, the Enforcement Deputy Tahsildar inspected the shop on 16.02.2015 and noticed minor variations. However, a show cause notice was issued by the 2nd respondent on 10.04.2015 levelling certain charges against the petitioner and the petitioner submitted her explanation. Having not satisfied with the explanation submitted by the petitioner, the 2nd respondent issued proceedings on 26.04.2015 suspending the authorization of the petitioner. Challenging the same, the present writ petition is filed.
3. This Court by an order dated 07.05.2015 granted interim suspension of the said proceedings and the said order is continuing till today. Now the learned Government Pleader produced the written instructions issued by the 3rd respondent justifying the order of suspension. But this Court is not inclined to go into the merits of the case, since a regular enquiry is pending before the 2nd respondent in respect of the allegations leveled against the petitioner. In the circumstances, the 2nd respondent shall complete the enquiry giving a due opportunity to the petitioner and complete the same within a period of three months from the date of receipt of a copy of the order and the order of suspension granted by this Court on 07.05.2015 shall continue till conclusion of the enquiry and passing of a final order by the 2nd respondent.
4. The Writ Petition is accordingly disposed of. Miscellaneous petitions, if any, pending in the writ petition shall stand closed. There shall be no order as to costs.
